Replacement of stateless persons’ cards and special type of passports


According to the Law No. 421-IQ dated 30 December1997of the Republic of Azerbaijan “on the approval of Regulation on special documents of stateless persons permanently residing in the Republic of Azerbaijan and foreigners intending to reside in the Republic of Azerbaijan for more than 30 days” and the Order No. 550, dated 2 September 2010 of the Ministry of Internal Affairs “on the approval of the instruction on the rules of citizens of the Republic of Azerbaijan, foreigners' and stateless persons' registrationover the place of residence and temporary residence , their provisionwith personal identification documentsandderegistration”, for renewing the identification cards until January 1, 1992 of stateless persons who have received a permit for permanent residence in the Republic of Azerbaijan and their children born until the Law «on citizenship of the Republic of Azerbaijan» of the Republic of Azerbaijan came into force, the ID card required to be renewed and the following additional documents considered for each circumstances are submitted to the office for combating illegal migration of Main Passport, Registration & Migration Department:

1. When the person turns 16 and 20 years of age, and then every five years or in case the lettering is distorted on the ID or it is invalid, an application form designated in the appendix No.1 and only front view-center full face 3 (three) color photographs from the same photocopy in photo size of 25mmX30mm without any headwear, with his/her appearance and features (glasses, beard, mustache and others) inherent in everyday life, receipt for payment of state fee, and a relevant certifying document if they are free of paying state fee;

2. Birth certificate or certificate on marriage or divorce issued by the SRSSA bodies together with the documents mentioned on the item 1 hereof, in case the surname, name, patronymic, and marital status of a stateless person permanently residing in the Republic of Azerbaijan change.
 
3. Renewal of identification card due to the relocation of the stateless person permanently residing in the Republic of Azerbaijanis is carried out as follows:
- When the relocated person permanently residing in the Republic of Azerbaijan moves to a new place of residence, he/she should appeal to the office for combating illegal migration of Main Passport, Registration & Migration Department not later than 10 days. For being registered on the new place of residence the person is required to submit the identification card and receipt on the payment of state fee for registration in addition to the following documents:

a) application-form (appendix №1) (download here);

b) from the person permanently residing in the Republic of Azerbaijan only front view-center full face 3 (three) color photographs from the same photocopy in photo size of 25mmX30mm without any headwear, with his/her appearance and features (glasses, beard, mustache and others) inherent in everyday life;

c) receipt on the payment of state fee, if they are free from the determined state fee, a copy of the relevant approval document;

d) if the person is married, certificate on marriage, if the marriage is broken, certificate on divorce;

e) in case the legal representative of the person to whom the identification card is issued appeals, a document which confirms his/her legal representation;

f) Extract from the state register of real estate on state registration of property rights;

g) lease or rent contracts concluded between lessor or landlord and lessee  or tenant respectively;

h) Order or other documents envisaged in the legislation of the Republic of Azerbaijan certifying to move into residential areas;

i) Application of the person providing living space to another person.

4. If the stateless person permanently residing in the Republic of Azerbaijan loses or intentionally damages his/her identity card, he/she should immediately notify the office for combating illegal migration of  Main Passport, Registration & Migration Department in written form indicating the time, place and situation in which the ID card was lost (or damaged), fill in the application form (appendix №1) and submit it to the office for combating illegal migration of  MPR & MD with three color photographs in 25x30 mm size and the receipt on the payment of state fee.

It is prohibited to require the documents which are not envisaged in the legislation from the person who has appealed for renewal of ID card.

For renewal of the travel document to go to the outside of borders of the Republic of Azerbaijan, a stateless person permanently residing in the Republic of Azerbaijan should submit an application form (appendix №2) (download here), ID card of the stateless person for using within the borders of the Republic of Azerbaijan, and if required, the documents which certify the necessity of  urgent treatment of those who go abroad or who go with him/her, or the documents proving the serious illness or death of his/her relative who lives abroad, and the receipt on the payment of state fee to the office for combating illegal migration of  MPR & MD.

According to the article 14 of the Law No. 223-IIQ dated 4 December 2001 of the Republic of Azerbaijan “On sate fee”:

- Sate fee in the amount of 6 manats for issuance of ID card to the stateless person permanently residing in the Republic of Azerbaijan to use within the borders of the Republic of Azerbaijan;

- Sate fee in the amount of 11 manats for issuance of travel document to the stateless person permanently residing in the Republic of Azerbaijan to go to the outside of borders of the Republic of Azerbaijan, is paid.

According to article 566 of the Code of Administrative Offences of the Republic of Azerbaijan:

In case the identification card, passport, Seafarers' Identity Document, and the documents of foreigner or stateless persons for residing in the Republic of Azerbaijan permanently or temporarily are lost or intentionally damaged, the fine in the amount of thirty (30) manats should be paid.
